Virginia is a BUYER BEWARE state, meaning that a buyer must do their due diligence and get a potential home inspected for any possible damages or concerns. “While sellers can’t lie outright or actively conceal a problem, and must honestly answer prospective buyers questions when asked, they aren’t obligated to point out the home’s flaws or defects to buyers.” The seller and the seller’s agent are not responsible for disclosing every small detail on the property. Here a few examples of what must be disclosed and what can be left out to potential buyers based on whether the agent must disclose and/or if the seller must disclose.
