Implementation of the policy by the AOAO’s and their managing agents many times resulted in application of maintenance fees without notice to the owners (especially where owners were paying their maintenance fees under an automatic payment process or owners bought their units after adoption of the policy) until the amount owed was so substantial that it resulted in foreclosure of the unit.
